  1. Definitions
    1. Coinranking: a company with limited liability Coinranking BV, established at Leonard Springerlaan 35, 9727 KB, Groningen, chamber of commerce number: 70788138.
    2. API: our secure and programmatic interface that provides real-time and historical data on cryptocurrency prices, blockchain statistics, market trends, and relevant news, accessible via authenticated requests with standardized data formats and enforced usage limits.
    3. User: Any individual, organization, or entity that accesses our Website, whether or not they are granted access to the API. Users are responsible for all activity conducted on the Website, regardless of whether they use an Access Key for the API. If a User is granted access to the API, they must ensure that all API usage complies with the applicable terms and conditions. This includes any employees, contractors, or agents acting on behalf of the User, provided their use of the API remains within the scope of the agreed-upon license.
    4. Website: the official online platform operated by us, through which information about our services, including the API, is provided. The Website may also serve as a portal for accessing account details, API documentation, and other resources related to the services offered under this agreement.
    5. Content: any data, materials, or information provided through the API, including but not limited to cryptocurrency prices, blockchain statistics, market trends, relevant news, and any other information that is made available to the User via the API or Website.


  2. Registration and Acceptance 
    1. By accessing or using the website or any associated services provided by Coinranking, users agree to be bound by these Terms and Conditions (“T&Cs”). The T&Cs apply to all users, including those accessing the website for general use or utilizing the API for programmatic access.
    2. Users who intend to access and use the API must agree to the separate API User Terms. The API User Terms govern the registration, access, and usage of the API, including but not limited to provisions regarding Data Usage, Compliance, Permitted and Prohibited Use, and Costs and Payments. Users must follow the formal registration process described in the API User Terms to become an API User, including receiving an Access Key to the API. Unauthorized use or misuse of the Access Key must be reported immediately as outlined in the API User Terms.
    3. In the event of any conflict between these General Terms and the API User Terms, the provisions set forth in the API User Terms shall prevail for API Users.
    4. By continuing to access or use the website or any associated services, including the API, users acknowledge that they have read, understood, and agree to these T&Cs in their entirety, in addition to any specific terms applicable to the API.


  3. Age restriction
    1. By accessing or using the website or the API, users confirm that they are at least 18 years of age. The use of the website and the API is strictly prohibited for individuals under the age of 18.
    2. If you are under 18 years old, you are not permitted to access or use the website, the API, or any related services, and you must immediately discontinue any such use.
    3. This age restriction applies equally to both general website users and API users, in accordance with applicable legal regulations concerning cryptocurrencies and financial data.


  4. License to Use the Website and API 
    1. Subject to compliance with these T&Cs, users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the website and, if applicable, the API. API users are additionally subject to the terms set forth in the API User Terms.
    2. Users may access and use the content available on the website for personal, informational, or internal business purposes. This license does grant users any rights to copy, modify, distribute, or publicly display any content from the website if allowed by Coinranking according to article 6.8. 
    3. API users are granted a limited, non-exclusive, non-transferable license to access and use the API in accordance with the API User Terms. The API User Terms govern Data Usage, Permitted Use, and Prohibited Use, and users are expected to adhere to the restrictions and guidelines outlined therein. Any programmatic use of the API data is limited to internal analysis as permitted by the subscription plan, and the data may not be resold or redistributed without prior written consent from Coinranking.
    4. By submitting content as a guest post, you retain ownership of your content but grant us a non-exclusive, perpetual license to use, display, and distribute it on our platform. You agree that your content complies with all applicable laws and does not infringe on third-party rights.
    5. The rights granted under this section may be revoked or terminated by Coinranking at any time for violations of these T&Cs or the API User Terms, including but not limited to misuse of the website or API, exceeding rate limits, or failing to comply with data removal requests as outlined in the API User Terms.


  5. User Obligations
    1. By accessing or using the website or the API, users agree to the following obligations:
      1. Accurate Information: Users must provide accurate, current, and complete information during the registration process and update this information as necessary to ensure its continued accuracy.
      2. Users must comply with these Terms and Conditions, as well as any applicable laws and regulations, including but not limited to those related to data protection, privacy, and the use of cryptocurrency.
      3. Users must not engage in activities that harm, disrupt, or interfere with the proper functioning of the website, API, or related services. Users are prohibited from attempting to gain unauthorized access to any part of the website, API, or other users' accounts.
    2. In addition to the general obligations above, API users are subject to additional terms and conditions set forth in the API terms. 
      1. API users must securely store and protect their API keys, credentials, and other sensitive access information. 
      2. API users are solely responsible for all activities conducted under their API keys and must promptly notify Coinranking of any unauthorized use or security breach.
      3. API users must use the data accessed via the API in strict compliance with the Data Usage and Permitted Use provisions in these T&Cs and the API terms. 
      4. API users are responsible for implementing and maintaining appropriate security measures to prevent unauthorized access to the API and misuse of API data. Failure to comply with these security obligations may result in immediate termination of API access.
    3. Failure to comply with any of the above obligations may result in:
      1. Suspension or termination of access to the website and related services.
      2. Suspension or termination of API access, in addition to other legal remedies. API-specific consequences, including rate limiting and liability, are further detailed in the API terms.


  6. Permitted Use and Prohibited Use
    1. Users are granted a limited, non-exclusive, non-transferable license to access and use the content on the website for personal, informational, or internal business purposes. Users may browse, view, and interact with the content, but they may not copy, modify, distribute, or publicly display any content without prior written consent from Coinranking.
    2. API users may use the data obtained via the API strictly in accordance with the terms and limitations set out in the API Agreement. Any specific restrictions, permitted uses, and licensing terms are outlined in the API Agreement and must be followed.
    3. Engaging in any illegal activities or using the website or API in violation of applicable laws and regulations.
    4. Attempting to access restricted areas of the website or API without proper authorization.
    5. Using any automated tools (e.g., bots, crawlers, scraping tools) to extract data from the website or API without prior authorization.
    6. Attempting to interfere with or disrupt the functioning of the website or API, including conducting Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks, or attempting to overload the system.
    7. Using the website or API to create products or services that compete with the offerings of Coinranking without express written permission.
    8. Reselling, redistributing, or publicly sharing any data or content from the website or API without the prior written consent of Coinranking. Reselling is permissible under the conditions mentioned in the API User terms. 
    9. Each API key issued is strictly limited to use by a single legal entity. Sharing or using a single API key across multiple entities, subsidiaries, or affiliates is expressly prohibited. Rate Limit Enforcement: The API key rate limits apply individually to each key and cannot be pooled, aggregated, or shared across entities. Any attempts to circumvent rate limits through shared or unauthorized use will result in immediate suspension or termination of access.
    10. Any violation of the provisions outlined in this section may result in the immediate suspension or termination of the user’s access to the website or API, and where applicable, legal action may be pursued. Users are responsible for any damages or losses arising from misuse of the website or API.


  7. Intellectual Property
    1. All content, materials, and information available on the website, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Coinranking or its licensors. Users are granted a limited, non-exclusive, non-transferable license to access and use the website content solely for personal, informational, or internal business purposes.
    2. Users may not copy, reproduce, modify, distribute, display, or create derivative works from any website content without the prior written consent of Coinranking. Any unauthorized use of website content is strictly prohibited and may result in termination of access and legal action. 
    3. All data provided via the API remains the exclusive property of Coinranking. Accessing the data through the API does not transfer any ownership rights to the user. API users are granted a limited, non-exclusive, non-transferable license to access and use the data solely as permitted under the terms of the API agreement and these T&Cs.
    4. API data may only be used for internal purposes, such as analyzing market trends, managing portfolios, or generating reports. Users are strictly prohibited from reselling, redistributing, or publicly sharing the data without the prior written consent of Coinranking.
    5. All trademarks, logos, and service marks displayed on the website or API are the property of Coinranking or its licensors. Users are not permitted to use these marks without prior written permission. All intellectual property rights, including but not limited to copyrights, patents, and trademarks, related to the website content and API data are protected by law and remain with Coinranking.


  8. Data Usage
    1. Coinranking collects personal data from users of both the Website and the API for the purposes of delivering services, improving user experience, and ensuring the proper functioning of the website and API. This data may include, but is not limited to, personal information such as name, email address, and usage data.

    3. In addition to general data collection, data from API users, including API keys and credentials, will be used to manage API access, monitor usage, and enforce compliance with API terms.
    4. Coinranking complies with all applicable data protection laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) and other relevant privacy laws. Users must also ensure that any personal data they handle or access through the website or API is processed in compliance with applicable laws, including obtaining any necessary consents for data processing.
    5. API users are required to implement appropriate security measures to protect their API credentials and access data. This includes safeguarding API keys and preventing unauthorized access to the API. In the event of a suspected or actual security breach, API users must notify Coinranking immediately.
    6. All data retrieved via the API remains the exclusive property of Coinranking. API users are prohibited from reselling, redistributing, or publicly sharing the data without prior written consent from Coinranking. The confidentiality of all API access credentials, keys, and sensitive information must be maintained at all times.
    7. Coinranking reserves the right to monitor the use of the website and API to ensure compliance with these terms. Coinranking may conduct audits to verify the proper use of the website and API, as necessary.
    8. For further details on how personal data is collected, used, and protected, users are required to review and accept Coinranking’s Privacy Policy. All users are responsible for ensuring compliance with the Privacy Policy in relation to any data processed through the website or API.


  9. Support and Maintenance
    1. Coinranking offers customer support for both website and API users. Website users can expect support related to accessing content, troubleshooting website functionality, and resolving account-related issues. API users can access technical support for API integration, usage, and resolving any issues related to API performance.
    2. API users are provided with technical support to assist with:

      3. Ensuring compliance with API usage limits and security measures
      4. Technical support for API users is available through Coinranking’s designated support channels, as outlined on the API documentation page. Support is generally offered during regular business hours, with response times depending on the user’s subscription level.
    3. Coinranking may schedule routine maintenance or updates to improve the website's functionality or security. Users will be informed of any planned maintenance via the website  on the website. Coinranking strives to minimize disruptions, but temporary service interruptions may occur.
    4. API users will be informed of any scheduled maintenance or updates that may impact the API’s availability or performance. Notifications regarding API maintenance will be communicated in advance via email or through Coinranking’s website. Coinranking aims to schedule maintenance during off-peak hours to minimize disruption, but API users are responsible for ensuring their systems can handle any temporary service downtime.
    5. In cases of emergency maintenance, where immediate action is required to fix critical security vulnerabilities or address major system failures, Coinranking may not be able to provide advance notice.


  10. Costs and Payment
    1. The website offers both free and premium services. Any premium services are subject to the fees outlined on the website, and users agree to pay all applicable fees for such services. Payment terms, including subscription fees, billing cycles, and payment methods, will be communicated during the purchase process.
    2. API users must subscribe to a pricing plan that corresponds to their intended level of use. Subscription fees are based on the user’s chosen plan, as outlined on Coinranking’s website. These fees may vary depending on factors such as data usage, rate limits, and support levels. All subscription fees are billed in advance, and failure to pay may result in the suspension or termination of API access.
    3. Payments for both website and API services can be made using the payment methods accepted by Coinranking, such as credit cards, PayPal, or bank transfers. Users will be billed according to the terms agreed upon during registration or subscription. All payments are non-refundable unless otherwise stated in the terms of the specific service.
    4. If a payment is not received by the due date, Coinranking reserves the right to suspend the user’s access to premium website services or the API until the outstanding balance is settled. Repeated failure to pay may result in the permanent termination of the user’s account.


  11. Privacy Policy
    1. Coinranking collects and processes personal data from both website users and API users in order to deliver services, improve functionality, and enhance user experience.   12. Assumption of Risk
    1. By using the website or the API, users acknowledge that they assume all risks associated with the use of cryptocurrency data, market information, and related services. Coinranking makes no guarantees regarding the accuracy, completeness, or timeliness of the data provided. Users are responsible for understanding the inherent risks of cryptocurrency trading and market volatility.
    2. API users acknowledge that the data retrieved through the API, including real-time market data, may be subject to inaccuracies, delays, or interruptions. Coinranking does not guarantee the absolute accuracy or availability of real-time data, and users understand that reliance on this data for financial decisions carries inherent risks. These risks include but are not limited to:
      1. Market Volatility: Cryptocurrency prices and market data can fluctuate significantly, which may lead to substantial financial losses.
      2. Data Inaccuracy: Real-time data provided by the API may not always be accurate, complete, or current due to factors outside Coinranking’s control.
      3. Technical Errors: API users assume the risk of data errors or service interruptions due to technical issues, third-party data providers, or system outages.
      4. Regulatory Changes: Changes in laws, regulations, or policies regarding cryptocurrency may impact the availability, legality, or accuracy of the data provided, potentially affecting financial decisions made based on this data.
      5. Security Breaches: Users assume the risk of data breaches, unauthorized access, or cyberattacks that may compromise the integrity, confidentiality, or availability of data retrieved through the API.
      6. Latency and Delays: Due to the nature of network connectivity, there may be delays in receiving or processing data through the API, which can result in the user making decisions based on outdated information.
      7. Third-Party Dependencies: The API may rely on third-party data sources or services, and interruptions, inaccuracies, or failures in these third-party services could affect the data provided to the user.

    4. Coinranking shall not be liable for any direct and/or indirect financial losses, damages, or adverse outcomes resulting from the use or reliance on the data provided through the website or API. Users assume full responsibility for their use of the data and any related financial risks.

    4. Coinranking has implemented security measures to protect the website and API from unauthorized access or tampering. Users agree to respect and not circumvent or disable any security features, including those designed to protect the integrity of the API or website infrastructure.


  14. Data Loss and Liability

Coinranking is not liable for any loss of data, whether through the use of the website or the API, Users are responsible for maintaining backup copies of their data and implementing their own security measures to protect against data loss. This includes any data uploaded, stored, or transmitted through the website or API.
    2. Coinranking does not guarantee the accuracy, completeness, or timeliness of any data provided via the website or API, including but not limited to cryptocurrency market data, trends, and related information. The data is provided "as is" and may be subject to errors, delays, or inaccuracies due to various factors, including third-party data providers and technical limitations. Users acknowledge that reliance on such data is at their own risk.
    3. API users expressly acknowledge that Coinranking is not liable for:
      1. Inaccurate Data: Coinranking is not responsible for any financial losses, business decisions, or other consequences resulting from the use of inaccurate or incomplete data retrieved via the API.
      2. Service Interruptions: Coinranking shall not be liable for any interruptions, downtimes, or delays in the availability of the API, whether due to scheduled maintenance, technical failures, or other unforeseen events.
      3. User Errors: Coinranking is not responsible for any issues arising from improper use of the API, including errors in data integration, unauthorized use, or failure to adhere to Coinranking’s guidelines.
    4. Coinranking is not liable for:
      1. Website Errors: Any damages, losses, or inconveniences resulting from errors, bugs, or downtime on the website.
      2. Inaccurate Content: Any losses resulting from reliance on content or information published on the website, including cryptocurrency-related data or financial advice.
    5. To the fullest extent permitted by law, Coinranking’s liability is limited to direct damages only. In no event shall Coinranking be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, business interruptions, or loss of data, arising from the use of the website, the API, or any data provided therein.
    6. Coinranking does not offer financial advice, and any data or information provided via the website or API should not be interpreted as such. Users are encouraged to seek independent financial advice before making decisions based on the data provided.
    7. Coinranking is not responsible for any issues or data loss caused by factors beyond its control, including but not limited to:
      1. Third-party service providers.
      2. Internet service interruptions.
      3. Cyberattacks or other malicious activities.
      4. User error or failure to follow security guidelines.



  15. Indemnification
    1. By using the website or the API, users agree to indemnify, defend, and hold harmless Coinranking, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

    2. In addition to the general obligations outlined above, API users agree to indemnify Coinranking for any claims, damages, or liabilities arising from:

      2. Any security breaches, unauthorized access, or misuse of API credentials that result in data loss, unauthorized data access, or damages to Coinranking or third parties.
      3. Any failure to adhere to Coinranking's guidelines, rate limits, or security protocols that result in damage, service interruption, or legal action.
    3. Coinranking will promptly notify the user of any claim for which indemnification is sought. The user agrees to cooperate fully in the defense of any claim and to bear the full cost of defense, settlement, or damages awarded. Coinranking reserves the right to assume exclusive defense and control of any matter subject to indemnification, in which case the user will still be responsible for all related costs.
    4. Users are not required to indemnify Coinranking for claims arising from Coinranking’s gross negligence or willful misconduct. 


  16. Modification and Variation
    1. Coinranking reserves the right to modify, update, or change these Terms and Conditions, including the API terms, at any time without prior notice. Any changes will become effective immediately upon being posted on Coinranking’s website or communicated through other appropriate channels. It is the user’s responsibility to review the Terms and Conditions regularly to ensure they remain informed of any changes.
    2. In the event of any material changes to the Terms and Conditions or API terms, Coinranking will make reasonable efforts to notify users. This may include notifications via email, website banners, or other direct communication channels.
    3. By continuing to use the website or API after any modifications to the Terms and Conditions or API terms, users signify their acceptance of the updated terms. If a user does not agree with any of the changes, their sole remedy is to discontinue use of the website and the API.

Coinranking  also reserves the right to modify, discontinue, or vary any aspect of the services provided through the website or API at any time, including changing access levels, data availability, features, or pricing. Such changes may be communicated through Coinranking’s website or other appropriate channels.

In the event of unplanned service interruptions due to technical failures, third-party service issues, or other unforeseen events, Coinranking will work diligently to restore access to the website or API as soon as possible. However, Coinranking is not liable for any damages, losses, or inconveniences resulting from such interruptions.
    4. Coinranking is not responsible for any financial losses, business interruptions, or other adverse effects that may occur due to service interruptions, whether planned or unplanned. API users acknowledge that service availability may be subject to additional limitations due to technical issues or external factors, such as third-party data providers.
    5. Users are responsible for implementing their own backup measures and contingency plans to mitigate the impact of service interruptions. API users, in particular, should ensure that their systems can handle temporary service downtime and have processes in place to manage any data disruptions during such periods.


  18. Termination of Use
    1. Coinranking reserves the right to terminate or suspend a User’s access to the Website or the API at any time, without prior notice, if the User is found to have violated these Terms and Conditions or the API terms, or engaged in activities deemed harmful, unlawful, or in breach of Coinranking’s policies.
    2. For API users, Coinranking may immediately terminate or suspend API access if:
      1. Violation of Data Use Terms: The user violates any of the data usage rules, including unauthorized resale, redistribution, or public disclosure of API data.
      2. Security Breach: The user is found responsible for a security breach, unauthorized access, or misuse of API credentials.
      3. Non-Compliance with Guidelines: The user fails to comply with API usage guidelines, rate limits, or security protocols.
      4. Failure to Pay Fees: The user fails to make timely payments for any subscription or usage fees associated with API access.
    3. Upon termination of access:
    4. The User’s Access Key for the API will be immediately deactivated.
      1. The User is no longer authorized to use any data, content, or services provided through the website or API.
      2. Any data retrieved via the API or stored on the website must be immediately deleted, unless otherwise required by law.
      3. Coinranking shall not be liable for any compensation, damages, or refunds in the event of termination due to the user’s violation of these terms.
    5. Users may choose to terminate their use of the website or API at any time. For API users, termination of access may result in the forfeiture of any pre-paid fees, and the User’s Access Key will be deactivated. Any remaining data usage or obligations related to data handling must be fulfilled, even after termination.
    6. Any obligations that arose before the termination, such as confidentiality, indemnification, and data usage responsibilities, shall survive the termination of the User’s access to the website or API.


  19. No Warranties
    1. The website and the API are provided on an "as is" and "as available" basis. Coinranking makes no representations or warranties of any kind, express or implied, regarding the operation, availability, accuracy, or completeness of the website or API, including any data, content, materials, or services provided.
    2. Coinranking disclaims all warranties, express or implied, regarding the website, including but not limited to:
      1. Fitness for a Particular Purpose: Coinranking does not guarantee that the website will meet the user’s specific requirements or expectations.
      2. Availability: Coinranking does not warrant that access to the website will be uninterrupted, error-free, or secure at all times.
      3. Accuracy: Any information or content provided on the website is for informational purposes only, and Coinranking does not guarantee its accuracy or completeness.
    3. API users acknowledge that:
      1. Accuracy of Data: Coinranking does not warrant that the data retrieved via the API is accurate, complete, reliable, current, or error-free. Cryptocurrency data is inherently volatile and may be subject to inaccuracies or delays.
      2. Availability of API: Coinranking makes no guarantees that the API will be continuously available or free from interruptions, including due to scheduled maintenance, system failures, or external factors.
      3. Data Integrity: Coinranking does not warrant that the data obtained via the API will be free from corruption, unauthorized access, or other security vulnerabilities.

  20. Non-infringement

    2. In the event of any issue or defect with the website or API, the user’s sole remedy is to discontinue use of the website or API.       2. Service Interruptions: Coinranking is not responsible for any damages or losses arising from interruptions, downtime, or unavailability of the API due to maintenance, technical failures, or unforeseen events.
      3. Security Breaches: Coinranking’s liability for security breaches, including unauthorized access to API data, is limited to the implementation of reasonable security measures and does not extend to damages caused by user negligence or failure to secure API credentials.
    3. For website users, Coinranking shall not be liable for:
      1. Website Errors: Damages arising from errors, bugs, or downtime on the website.
      2. Content Accuracy: Losses resulting from reliance on inaccurate or incomplete content or information published on the website, including any financial or cryptocurrency-related information.
    4. In any case, the total liability of Coinranking for any claims arising out of or related to the use of the website or API shall be limited to direct damages only and shall not exceed the total amount of fees paid by the User to Coinranking in the twelve months preceding the event that gave rise to the liability. Coinranking’s liability is limited to the extent that users have fulfilled their responsibilities under these Terms and Conditions, including securing API credentials and following data usage guidelines.

      1. Intentional Misconduct or Gross Negligence: Coinranking's liability is not limited in cases of intentional misconduct or gross negligence.
      2. Statutory Rights: Any liability that cannot be limited or excluded under applicable law.
